What we collect
When you send a request through a form on this site
- Your name, and the email address or phone number you give us, with its country code.
- Details about your vessel and trip: vessel name, length and flag, expected arrival date and port, the services you are asking about, and your message.
- Any documents you choose to attach, such as crew lists, registration or clearance papers, or photos. These can include passport details or other personal information about crew and guests. Please only send what is needed for your request.
- The page you sent the form from, the date and time, and your device's IP address. We use these to answer you, keep records, and block spam and misuse.
When you call, email or message us
We keep what you send us, along with your phone number or email address, so we can answer and arrange the services you ask for. Messages through WhatsApp are carried by WhatsApp (Meta) under its own privacy policy.
When you browse this site
We use Google Analytics to understand how the site is used. It sets cookies and collects information such as the pages you view, how you arrived (for example from a search or a link), your general location (city or region), your device and browser type, and whether you tap a phone, WhatsApp or email link or send a form. We use this only in summary form to improve the site. Our website host also keeps standard server logs (IP address, pages requested, browser type) for security and to keep the site running.
Advertising on Facebook and Instagram
We use the Meta Pixel, a piece of code from Meta Platforms, the company behind Facebook and Instagram. It tells Meta when someone views a page on this site, taps a phone, WhatsApp or email link, or sends a request form, along with standard browser details and cookies. We use it to measure our Facebook and Instagram advertising and to show our ads to people who have visited this site. Meta may connect this activity to your Facebook or Instagram account, and when you send a form it may receive a scrambled (hashed) copy of the email address or phone number you entered so it can make that match. The message you write and the documents you attach are never sent to Meta. Meta handles this information under its own privacy policy.
How we use your information
- To answer your inquiry and give you a quote.
- To arrange the services you request, such as customs and immigration clearance, Notice of Arrival and Departure filings, dockage, fuel, provisioning, freight, travel and concierge services.
- To keep business, billing and compliance records.
- To protect the site and our systems against spam, fraud and misuse.
- To understand, in summary form, how the site is used so we can improve it.
- To measure our advertising on Facebook and Instagram and show our ads to people who have visited this site.
We do not use your information for purposes unrelated to your request, and we do not send marketing email unless you have asked for it.
Who we share it with
We do not sell or rent your personal information. The only information that reaches an advertising company is the website activity described under "Advertising on Facebook and Instagram" above. Otherwise we share it only as needed to do what you ask, or as the law requires:
- Government authorities, such as U.S. Customs and Border Protection and the U.S. Coast Guard, when your request involves clearance or arrival and departure filings, and any other authority when the law requires it.
- Service partners who carry out part of your request: marinas, fuel and provisioning suppliers, freight forwarders, travel and transport providers, and partner agents such as Dockside Management for Puerto Rico. Each receives only what it needs for its part.
- Companies that run our systems for us: our website host, our email provider (Microsoft 365), our customer records system (Method CRM), and Google Analytics. They handle information on our behalf and may not use it for their own purposes, except as described in their own privacy policies for analytics.
- Meta Platforms (Facebook and Instagram), which receives the website activity described above through the Meta Pixel and uses it for our ad measurement and under its own privacy policy.
- Others when required: to comply with the law or a valid legal request, to protect our rights or safety or those of others, or as part of a sale or reorganization of our business.
How long we keep it
We keep inquiry and service records for as long as we need them to serve you and to meet our business, tax and legal record-keeping obligations. After that we delete them or keep them in a form that no longer identifies you. Google Analytics data is kept under the retention setting of our Google Analytics account.
How we protect it
The whole site uses an encrypted (HTTPS) connection. Documents you attach are stored in a private area of our server that is not part of the public website and are never published. Access to inquiries is limited to the people who handle them. No method of sending or storing information is completely secure, so please contact us by phone if you would rather not send a sensitive document online.
Your choices
- Access, correction and deletion. You can ask us what information we hold about you, ask us to correct it, or ask us to delete it, by emailing operations@americanyachtagents.com. We may need to confirm your identity, and we may keep information we are required by law to keep.
- Cookies and analytics. You can block or delete cookies in your browser settings, or install Google's Google Analytics opt-out browser add-on. The site works without cookies.
- Ads on Facebook and Instagram. You can control how Meta uses your activity for ads in your Meta ad preferences, and blocking cookies in your browser also stops the Meta Pixel from recognizing you.
- Do Not Track. Browsers handle "Do Not Track" signals in different ways, and this site does not currently change its behavior when it receives one. The cookie and opt-out choices above are available to everyone.
Visitors from outside the United States
We are based in the United States, and the information you send us is stored and handled in the United States, where privacy laws may differ from those in your country. If you are in the European Economic Area, the United Kingdom or Switzerland, we handle your information to take the steps you ask for before and while we provide services, to meet legal obligations such as customs and arrival filings, and for our legitimate interests in running and protecting our business. You may have the right to access, correct, delete or restrict your information, to object to how we use it, and to complain to your local data protection authority. Contact us first and we will do our best to help.
Children
This site is meant for yacht captains, owners, crew and their representatives. It is not directed to children under 16, and we do not knowingly collect information from them. If you believe a child has sent us personal information, contact us and we will delete it.
Links to other sites
This site links to other websites and services, such as Facebook, Instagram, LinkedIn, WhatsApp and news articles. Their own privacy policies apply when you use them.
Changes to this policy
If we change this policy, we will post the new version on this page and update the date at the top. If a change affects how we use information we already hold, we will make it clear on this page before it takes effect.
